Suspended CEO seeks Interim Injunction, Judicial Review, damages and costs
The suspended CEO of the Cook Islands Investment Corporation (CIIC), John Tini Jnr, has filed an application in the High Court for an interim injunction seeking two injunction orders and costs on the grounds set out in an Affidavit which is also in support of a Notice of Motion for a Judicial Review.

In both the application for an Interim Injunction and the Notice of Motion Tini names Sir Terepai Maoate as first respondent in his position as Minister responsible for PERCA and second respondent in his position as Attorney General in lieu of the Crown pursuant to the Crown Proceedings Act 1950 (as amended). The papers were filed on 16 October 2009.
The application for interim injunction asks for an order compelling The Minister for PERCA, its servants and or agents to;
-cease all investigations against Tini pending the outcome of the Judicial Review application,
- prohibit the Minister for PERCA, its servants and or agents from making media publications in relation to Tini in all media outlets in any manner, form or kind that divulges their investigations in relation to Tini, pending the outcome of the application for a Judicial Review.
Tini also seeks costs.
In the Notice of Motion for a Judicial Review, Tini seeks the matters as above.
The High Court is yet to set a date for a hearing
