Family feuds over land
A nephew has been asked to vacate the premises that he thought belonged to his father and came to court to seek an injunction against his uncle. He reacted by seeking an injuction to prevent his eviction by his uncle, Mann Unuia. Legal counsel, Tuaine Marsters asked the court for an adjournment to allow the persons to sort out the matter without troubling the court on what was basically a family matter.
Marsters said the house was owned by the applicant’s father (brother to the uncle trying to evict her client) and was coming to Rarotonga to sort out the matter with his brother.
However, the case was not that simple because in fact, they are half brothers and has no blood-right to the land which has been partitioned to the applicant’s family. They are prepared to give their brother the right to have quarter acre but they are occupying a much larger share of the land. However, the nephew had refused to discuss the matter with his uncle who was then forced to take drastic action and evict him. Justice Hingston adjourned the case to allow the family to sort out their differences in an amicable manner. - NB
