Attempt to shut down Scientology display
An attempt is being made by government officials to shut down the Scientology display at the Punanga Nui market.
The Times learnt of the attempt made, late on Friday evening, by the Crown Law Office to have the display closed down.
Apparently Crown law is of the opinion that the erection of the tent at the market is in breach of the provisions of the “Religious Organisations Restrictions Act 1975” namely s4(1) relating to restrictions on use of buildings, which includes tents.
Crown law contacted the Ministry of Agriculture who oversee the Market and also the Police to advise them that the Scientology tent breaches the Act as it is for a religious purpose, or intent even if it is spreading information on their beliefs.
Crown law advised both agencies that under the legislation an Order can be obtained for the tent to be destroyed (s4(2)). However, Crown Law advised that Agriculture/Police ask the Scientologists to take their tent down.
The Times was not able to establish prior to going to print, whether the Crown Law opinion was produced because of a complaint or if Crown Law were being proactive in advising the two government agencies of the requirements of the law.
